Condition of Sale

1) GENERAL
a) These conditions apply to all orders for the supply of equipment in the U.K by the company.

b) Where the customer is obtaining finance for the purchase of equipment by means of a loan from a finance company, then in consideration of the company agreeing to sell the equipment to the finance company, the customer agrees to be bound by these conditions of sale.

c) The placing of an order by a customer subject to these conditions of sale shall constitute the entire contract between the company and the customer.

d) All orders are subject to confirmation and acceptance by the sales controller based at the company’s head office.

2) TERMS OF PAYMENT
a) ln the case of cash sales, payment of the total price (less any deposit already paid) shall be made by the customer to the company at the latest on the delivery of the equipment.

b) ln the case of sales financed by a loan from the finance company, delivery of the equipment will take place when the application for the loan has been approved by the finance company.

3) WARRANTY
a) The company will repair or replace free of charge any part of equipment sold by it which are defective due to faulty

materials or workmanship within the time frame agreed ln the Warranty section on the reverse of this page.
b) The company shall not take any responsibility for the replacement of batteries, keys, chargers or the repair of punctures

under the Warranty.
c) The company shall not be under any liability under paragraph (a) hereof in respect of any equipment which has been altered, tampered with or used otherwise than in accordance with the instructions issued by the company.

d) lf a call out is made for a repair under the warranty cover and upon arrival, there is found to be no fault with the product then a £50.00 call out fee will be applied to the visit.

e) The Warranty is guaranteed personally by the company, solely to the customer named on the reverse of this Order Form. The warranty is non-refundable and non-transferable upon sale, transfer or death of named customer.

4) REPAIRS

a) All repairs not covered under the warranty will be fully chargeable, please refer to Warranty Information Sheet for further details.

b) Charges will vary on a case to case basis but all will include a standard £80.00 call out fee which is to be paid in full on the date of the visit.

5) TERMS OF DELIVERY

a) The company shall use its best endeavours to fulfil promptly all orders made by customers, but will not be responsible for any delay due to matters beyond its control.

6) PASSING OF PROPERTY

a) For cash sales, ownership of the equipment sold shall remain with the company until the equipment has been delivered and paid for.

7) CANCELLATION RIGHTS

a) lf you cancel this contract, we will reimburse to you all payments received from you. We may make a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of unnecessary handling by you. We will make the reimbursement without undue delay, and not later than-

(i) 14 days after we receive back from you any goods supplied, or (ii) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or (iii) lf there were no goods supplied, L4 days after the day in which we are informed about your decision to cancel this contract.

b) We will make the reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

c) lf the consumer has received goods in connection with the contract we will collect the goods.

d) Your right to cancel will be lost if goods are unsealed and therefore not suitable for resale due to health protection and/or hygiene reasons e.g. Bath lift, Adjustable Bed & Riser Recliner Chair.

NOTICE OF THE RIGHT TO CANCEL
You have the right to cancel this contract within 14 Days without giving any reason. The cancellation period will expire after 14 days from the day on which you acquire,or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right to cancel, you must inform us: Bay Healthcare Ltd, Unit 40, Galgate Mill, Chapel Lane, Galgate, Lancashire, LA2 0PR (E-mail: info@bavhealthcareltd.co.uk)of your decision to cancel this contract by a clear statement (e.g. a letter sent by post or e-mail). You may use the attached model cancellation from, but it is not obligatory. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
